Possession of Hallucinogenic Drugs

Criminal Lawyer Defending Those in Ann Arbor, Detroit, Grand Rapids, Lansing and Throughout Michigan Against Drug Charges

Possession of hallucinogenic drugs including LSD, Peyote, PCP and Psilocybin is illegal in the state of Michigan; if you are found to be in possession, you may be prosecuted at the state or federal level. While use of these drugs is usually considered a misdemeanor, possession in any amount is a felony. Individuals who are convicted will face extremely serious penalties without the guidance and legal expertise of a skilled Michigan drug crime attorney. At Grabel & Associates our team is widely known as one of the best in Michigan when it comes to defending those charged with drug-related offenses.

In Michigan as well as the rest of the U.S., the 'war on drugs' is never ending. Police and prosecutors take a very vigorous approach in their efforts to put individuals who they believe are involved with illegal drugs or substances behind bars. Authorities cast a wide net to capture those who are simply occasional users, and often use every tactic in their arsenal to bring more serious charges such as possession or possession with intent to deliver/distribute.

Types of Hallucinogens

LSD - Sold in capsules, tablets and liquid form, LSD is a hallucinogen usually taken orally. The "trip" may last as long as 12 hours.

Peyote - Derived from the peyote cactus, disc-shaped buttons found at the roots of the cactus are cut and dried, then chewed or soaked in water resulting in a liquid which provides the intoxicating effects.

PCP - This white crystalline powder comes in many forms, and can be taken into the body in a number of ways. Capsules, colored powders, and tablets are smoked, taken orally or snorted. Some individuals apply powder forms of PCP to marijuana before smoking. Effects generally last about 4 to 6 hours.

Psilocybin - Certain mushrooms contain this substance, which is often used to brew tea, or added to foods. Effects from ingesting Psilocybin begin quickly, and last about 6 hours.

Penalties for Possession of Hallucinogens in Ann Arbor, Detroit, Grand Rapids, Lansing and Throughout Michigan

In Michigan, various drugs are classified under certain schedules according to whether they serve any medical purpose, and the potential for abuse and/or addiction. Schedule I drugs are considered the most dangerous and addictive; therefore individuals who have committed an offense involving these drugs are subject to the harshest of all drug penalties if convicted.

Penalties for hallucinogens possession according to the Michigan Penal Code 333.7403:

Schedule I or II controlled substance:

  • Between 25g and 50g, prison time of up to 4 years, fines of up to $25,000 (felony)
  • Between 50g and 450g, prison time of up to 20 years, fines of up to $250,000 (felony)
  • Between 450g and 1kg, prison time of up to 30 years, fines of up to $500,000 (felony)
  • Over 1kg, life imprisonment, fines of up to $1,000,000 (felony)

In addition, your sentence may be enhanced if you are found to be in possession of hallucinogens in certain locations such as near a school, church, park or business.

Both state and federal authorities are extremely serious about putting offenders behind bars. Police and prosecutors are cracking down hard on the use, possession or sale of drugs today, more so than ever before. They will find any opportunity to turn what would have been a possession charge into a charge of possession with intent, which means even more severe punishment.
